PPVFRA Plant Variety Protection in India

Securing Intellectual Property Rights on Plant Varieties

Under the Protection of Plant Varieties and Farmers' Rights Act, 2001 (PPV&FRA), seed companies and plant breeders can secure statutory intellectual property protection for newly bred plant varieties, parental lines, and hybrids in India. Registration grants exclusive commercial rights to produce, sell, market, distribute, import, or export the registered variety for a statutory term.

Categories of Protectable Varieties under PPV&FRA

  • New Varieties: Newly bred varieties that satisfy the criteria of Distinctiveness, Uniformity, and Stability (DUS) and have not been sold in India for more than 1 year prior to filing.
  • Extant Varieties: Varieties already notified under Section 5 of the Seeds Act 1966 or varieties of common knowledge.
  • Essentially Derived Varieties (EDV): Varieties derived predominantly from an initial protected variety while retaining its essential characteristics.

DUS Testing & Registration Workflow

  1. Dossier & Passport Data Compilation: Complete Form I application providing parentage details, morphological characteristics, and breeding history.
  2. Submission of Reference Seed Samples: Deposit specified quantities of clean, high-germination seed samples to the PPV&FRA Registrar for DUS testing.
  3. Multi-Location DUS Field Trials: PPV&FRA designated centers conduct 2 consecutive seasons of DUS field trials to verify Distinctiveness, Uniformity, and Stability against reference varieties.
  4. Gazette Publication & Registration: Upon passing DUS criteria, the variety is published in the Plant Variety Journal for opposition, followed by the grant of the Registration Certificate.
